1. General Provisions

These Terms of Service (hereinafter referred to as the "Terms") govern the use of Goosh Analytics (hereinafter referred to as the "Service").

By using the Service, you confirm your agreement to these Terms and our Privacy Policy.

2. Description of the Service

Goosh Analytics is an influencer marketing analytics platform. The Service allows you to:

• Manage a database of bloggers and influencers you work with
• Create and track advertising placements (campaigns) with bloggers
• Generate tracking links to measure click-through performance
• Connect Instagram Professional accounts to automatically retrieve media performance metrics (views, reach, likes, comments, saves, shares)
• Calculate campaign KPIs such as CPM, CPC, CTR, CPL, ROAS, and engagement rates
• View analytics dashboards with charts, trends, and performance comparisons
• Communicate with other platform users via built-in chat

3. Account Registration

To use the Service, you must create an account by providing a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and up-to-date information

4. Instagram Integration

The Service integrates with the Instagram API provided by Meta Platforms, Inc. When you connect an Instagram Professional account:

• You authorize the Service to access your media insights through Meta's official Instagram Login
• The Service only accesses performance metrics (views, reach, likes, comments, saves, shares) — not private messages or content
• You may revoke access at any time through your Instagram account settings
• Your use of Instagram data through our Service is also subject to Meta's Platform Terms

5. Service Provided "As Is"

The Service is provided on an "as is" basis without any warranties, express or implied, including but not limited to:

• Warranties of uninterrupted availability
• Warranties of data accuracy
• Warranties of fitness for a particular purpose

Instagram metrics are provided by Meta's API and may be subject to delays of up to 48 hours. We do not guarantee real-time accuracy of third-party data.

6. Prohibited Use

When using the Service, you must not:

• Use the Service for sending spam or unsolicited messages
• Manipulate click statistics (fraud, bots, scripts)
• Use the Service for any illegal activity
• Attempt to gain unauthorized access to the system
• Violate the rights of third parties
• Share Instagram insights data obtained through the Service with unauthorized third parties
• Use the Service in violation of Meta's Platform Terms or Instagram's Terms of Use

We reserve the right to suspend or terminate access without notice upon discovery of violations.

7. Limitation of Liability

We shall not be liable for:

• Any damages arising from the use or inability to use the Service
• Actions of third parties, including bloggers, advertisers, or platform providers
• Data loss due to causes beyond our control
• Changes in the operation of third-party services (Instagram, WhatsApp, Meta)
• Inaccuracies in metrics provided by third-party APIs

8. Intellectual Property

All rights to the Service, its design, code, and content belong to the Service owner unless otherwise stated. User-generated content (company data, blogger information, campaign data) remains the property of the respective users.

9. Data Deletion

You may request deletion of your data at any time. Please refer to our Data Deletion page for instructions. Upon account deletion, all associated data will be permanently removed within 30 days.

10. Changes to These Terms

We may update these Terms from time to time. By continuing to use the Service after changes are published, you agree to the updated Terms. We will make reasonable efforts to notify users of significant changes.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal action.
